Terms of Service & Platform Agreement

01.Acceptance & Scope

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and HXLABZ ("HXLabz", "we", "us"). By accessing our website, joining our waitlist, interacting with our simulation terminals, or utilizing our APIs, you agree to be bound by these Terms.

If you are accessing our services on behalf of an enterprise, research institute, or corporate entity, you represent and warrant that you possess the full corporate authority to bind that entity to these Terms.

02.Eligibility & Authority

You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to access our platforms or join our waitlist. Our computational infrastructure is not intended for use by minors.

03.Waitlist System & Token Custody

Our waitlist operates under strict technical parameters:

• No Guarantee of Immediate Allocation: Registering for the waitlist and receiving an assigned sequence identifier (e.g. HX-000042) does not constitute a guaranteed commercial delivery date or compute reservation. Cohort access is granted based on infrastructure deployment capacity.
• Private Token Custody: Upon registration, you are issued a 48-character cryptographic token. You are solely responsible for maintaining the confidentiality of this token. HXLabz cannot reconstruct lost tokens because only their one-way cryptographic SHA-256 hash is retained on our servers.
• Self-Serve Cancellation: You may forfeit your position and permanently delete your record at any time via /waitlist/status.

04.Intellectual Property & Proprietary Rights

All software, visual canvases, CFD simulation engines, neural network topologies, documentation, logos, and system architectures displayed on our platforms are the exclusive intellectual property of HXLABZ and its licensors.

Except as explicitly authorized in writing, you shall not copy, decompile, reverse-engineer, disassemble, or derive source code from any portion of the platform.

05.Prohibited Activities & Conduct

You agree not to engage in any of the following restricted activities:

• Deploying automated scrapers, spiders, or bots to harvest waitlist IDs or email addresses.
• Executing brute-force attacks against token verification endpoints.
• Submitting fraudulent, disposable, or unauthorized email domains to inflate waitlist counts.
• Interfering with server load, network topologies, or computational nodes through denial-of-service attempts.

06.Computational Systems & Simulation Disclaimers

All interactive simulations (including CFD canvases and neural topology visualizers) and AI outputs provided via our web portal are for research, demonstration, and preliminary evaluation purposes only.

THE PLATFORM AND ALL SIMULATION OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO FITNESS FOR A PARTICULAR PURPOSE, STRUCTURAL AERODYNAMIC VALIDITY, OR FREEDOM FROM LATENCY.

07.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HXLABZ, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF YOUR ACCESS TO OR USE OF THE PLATFORM.

08.Suspension, Erasure & Termination

We reserve the right to suspend or terminate any waitlist record or system access without prior notice if we detect abusive activity, automated scripting, or material violation of these Terms.

09.Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Hyderabad / Bengaluru, India.
